Unbelievable LIES by TPE Management
The following is evidence to show what happens when I have escalated issues in the past to the ORR, (Office of the Rail Regulator). But the question has to be asked? Why should I have to escalate any issues on health & safety to an outside organisation?
TransPennine Express Management tell the Office of the Rail Regulator that I haven't informed them about the diabolical state of York messroom and toilets, like I have said all along, they IGNORE me and then BLATANTLY LIE to the ORR, what chance did I stand, to get them to listen to anything?
Is there any wonder you have to resort to alternative measures?
Disgraceful conditions of York Messroom and Toilets.
These are a series of pictures (first) and reports dating from 26th April 2005 to the 18th July 2008.

All the sinks were like this
Toilets never cleaned and this one was not secured to the floor, hence each time it was used, excrement flooded the floor
Just a common sight, filth and grime, top to bottom
One side of a fridge, massive build up of dirt
Top is warped through damp, filth everywhere
The other side of the fridge, not cleaned in years
Would you put your food on here?

11. DRIVER COMPLAINS ABOUT STATE OF TOILETS AT YORK
Driver:P Webb Depot: York Turn No:YK932
Details: 01.20, Driver P Webb, advised that the state of the staff toilets at York is disgusting. According to him there are two toilet seats missing in the gent’s toilets and in the ladies toilets there is no hot water and bins are over flowing and he claims that things are growing under the toilet seats.
(Two female on train cleaners told him about the state of the ladies). Perry has taken pictures and said that if it wasn’t for the holiday period he would get the environmental health to come out.
Perry was asked if he had told the GNER Station Manager but he hadn’t yet as he said that they are not interested; he said he will go and give them the information he has collected.
Can you confirm that these repairs and cleaning have been carried out ??.
Do you have a response to the invitation to tour the area on the morning of the 15th ?.

Hi all,
For those who missed the announcement at last night's York ASLEF Branch meeting, Peter Smith, the ASLEF H&S Rep for National Express at Newcastle is calling a meeting of all interested Safety & LLC Reps next Monday Sept 15th at 10.00am at the York Platform 1 messroom with the view to organising a joint campaign to get our various TOC managements to do something about the basic inadequacy and general poor state of cleanliness of that messroom and that failure to make any improvements or provide alternatives will lead to our refusing to recognise it as a DBC/PNB location and advising all traincrews not to use it.
We need to have a joint approach as so many different managements are involved from Network Rail as titular owners, National Express as managers, Northern Rail as sub-contractors and many other TOCs/FOCs paying in towards it.
There have been many years of campaigns to get something done about this facility but it tends to be little more than a lick of paint and a few new extra chairs (and more recently the intrusion of various gaming and other machines).
Its probably too late to get released to attend this informal, unofficial meeting however if you can get there I would.
I haven't got an email for Peter yet but his mobile number is 0790-197-xxxx if you want to contact him for more information, etc.. It might be worth contacting him even if you can't make it on Monday so you can be involved in any future action.
Please pass on this information to anyone else who might be interested.

I am contacting you regarding the complaint you made to York City Council about the state of the welfare facilities at York station. The complaint was passed to ORR who are the enforcing authority for such matters on railway stations.
A colleague has visited York and found the state of the facilities to be acceptable. She discussed the matter with those who were using the facilities at the time of her visit and none of them had issues that they wished to raise.
When discussing your complaint with TPE I was surprised to find that you had not raised the issue with them prior to complaining to the enforcing authority.
We have written to you on two previous occasions (17/10/06 and 22/02/08) explaining the procedure you should follow when you have concerns about your workplace; that is first raise your concerns with TPE/ASLEF and only when that avenue has been fully explored should you refer the matter to ORR. Please ensure that you follow this procedure on future occasions.

When you look through the various reports and emails did I actually report the toilets and messroom facilities in York to TPE Management?

Not only did I complain, but so did ASLEF, so why did Mark Lenderyou, Her Majesty`s Inspector of Railways think otherwise?
Surely not? Your trying to tell me that a Company the size of First Group who supposedly have ethic`s and moral`s on SAFETY would allow one of their Train Operating Companies to tell lies to the ORR.
"When discussing your complaint with TPE I was surprised to find that you had not raised the issue with them prior to complaining to the enforcing authority".
Not raised the issue? What do the above emails and reports tell you?
They clearly show that I complained to TPE Management, what they do not show is the reason why they were IGNORED and the reason TPE Management LIED to the ORR.
The reason was, TPE Managements hatred towards me, (Outstanding Grievance is further evidence), the reason for the hatred was because I always wanted answers on health and safety issues and would never back down while they just wanted me to go away. So they used a weapon of their choice called IGNORANCE which was a deliberate ploy to spark a reaction, they started this a few months after they took over the franchise in 2004 (which I will prove later on this website).
So I CHALLENGE, OPERATIONS DIRECTOR PAUL WATSON, MD NICK DONOVAN and previous MD VERNON BARKER, when you look at this evidence and there is much more to follow of a similar nature, are you happy that you have such an ignorant management?
Are you happy that YOUR MANAGEMENT DELIBERATELY IGNORED HEALTH & SAFETY ISSUES? Is this still going on? What do you intend to do about this?
These are serious allegations with irrefutable evidence, stop being blinkered and I ALSO CHALLENGE YOU, if this is in your mind all fabricated then do something about it, CHALLENGE IT, I would have no problem whatsoever seeing you all in a courtroom.
Surely a Company the size of First Group against ME, is like DAVID v GOLIATH, although perhaps I am being a bit too kind to myself in that statement.

When I was health and safety rep it was raised numerous times.
Like most problems, but as was the norm, nothing was ever done. I stopped doing the health and safety job after numerous requests for proper facilities including complaining to yourselves.
Health and safety is quite simply a joke, the health and safety at work act 1974 and the management and welfare regulations to name just two are a complete waste of time.
As for noise in the 185 cabs, a little journey from Manchester to Huddersfield is hardly sufficient.

The IGNORANCE on the warning horns is still the same in 2014 as it was back then, someone will end up dead and NOBODY BUT NOBODY gives a damn!
