Firstly I would like to apologise for taking up your valuable time. I am one hundred per cent certain you will realise that this is not a case of sour grapes. I always produce evidence to back up my claims.
My dismissal runs far deeper than the events of 14th January 2009. I
had many years driving experience and became a driver at the age of 21, I had an exemplary record and never passed a signal at danger. My railway knowledge was and is immense.
My dismissal was down to reporting issues that I felt required looking at from a safety viewpoint, sadly all I ever encountered was unbelievable ignorance, an ignorance that makes you ill, an ignorance that forces a reaction to have another go. Please read the “Case Management Discussion” for evidence of ignorance and look at some of the ignored reports I have put on this website in the section, "Selection of IGNORED reports".
Summit Tunnel had the potential to cause a huge loss of life, all that was required is another train travelling in the opposite direction. Yet this as shown in the section “Summit Tunnel Accident”, was completely avoidable, yet my reports and words were ignored.
I still to this day do not understand the mentality behind this ignorance, after all, I was always approachable and constantly requested meetings, proof of which can be seen in reports on this site, furthermore a meeting was requested by the railway doctor in her report after TPE made the appointment for me to see her, see the section, "TPE Events of 2004", yet once again it fell on deaf ears. You have got to ask the question, why ignore a doctors recommendation, why continually ignore me?
I would like to ask you Sir, as an intelligent human being, how would you feel if over the course of years you were systematically ignored on safety issues you felt extremely strongly about, made even worse that when you are pushed to the limit you have to seek help from the Office of the Rail Regulator and especially when the responses you receive state the following, "When discussing your complaint with TPE I was surprised to find that you had not raised the issue with them prior to complaining to the enforcing authority” and “When I discussed your complaint with TPE they were unaware of your concerns”.
Those responses were a complete kick in the teeth, extremely demoralising, proof that shows I categorically informed TPE management can be viewed in the sections, “Blatant lies to the HMRI (1) Messrooms” and “Blatant lies to the HMRI (2) Noise". Ask yourself, why would TPE management lie?
There was an attempt made to dismiss me in late 2008, details of which can be found in the section, “Fuel point entrapment”.
What occurred on the 14th January was an everyday occurrence in cold and wet weather, I complained so many times about the warning horns, proof is on this site, always to no avail. I have evidence that shows other drivers behaved the same way and far worse, trains were being driven at line speed with complete failures of the warning horn. Evidence is available in the sections, "Warning horns (The Shocking Truth)".
The lengths that those 9 individuals went too is absolutely astounding, the mistakes and vindictive nature is there for everyone to see. Without going into great detail, please read this site, it highlights in every section the lies and deceit.
The witness statement of Route Driver Manager Mark Atkinson is full of so many lies (PERJURY), they are unbelievable. In order to dismiss me, this management did as they pleased, the investigation report by Stephen Percival was quite simply a character assassination, it never investigated the true facts of the case, instead highlighting totally unrelated incidents that had nothing whatsoever to do with the events of the 14th January 2009.
The investigation was that poor that it never ascertained anything about the most paramount issue, the warning horn. Yet Barry Cook who
levelled the charges, charged me with failing to report a very non specific “defective warning horn”, which isn't mentioned once in the investigation report.
I am then interrogated (please listen to the audio) by Route Driver Manager Mark Atkinson in my hearing who suddenly decides the warning horn failure was a complete failure, despite explaining to him throughout that it was a partial failure. Also listen to the amount of times he constantly repeats himself and how he openly states that I am guilty before listening to my defence which can be found in the section, "Hearing 30th June 2009 with audio", it is under number 91.
I was promised by Vernon Barker that my complaints would be looked into by an outside source which was later withdrawn by a woman called Charlotte Pears for supposedly not cooperating while being off work sick.
Then there is the Manager Ged Higgins fiasco which in itself is proof enough that my dismissal was premeditated, just look at the final outcome of the grievance by York Driver Geoff Lee against this man for being a liar. In any event the outcome should have been completed before my appeal even took place. Evidence can be found in the sections, "Ged Higgins Responses" and the "Witness Statement Driver Geoff Lee".
I lost my complete life, wife, young son, house, absolutely everything, there have been times when I have been suicidal, the whole railway know that I should never have been dismissed, it was the biggest stitch up of all time. Procedures were totally ignored by all managers concerned.
I have it on good authority that TPE are recognised within First Group as the worst performing company regarding employee relations, I believe that is why an outside company OCP has recently been brought in to investigate this, you only have to look at the “your voice” survey results over the years.
This is your chance to get some credibility back, please do the decent and honourable thing and investigate each section of this website, on reading, it will surely make you wonder why TPE have done absolutely nothing about my numerous claims on this site, but I will tell you why, because there is nothing anyone can do when they are faced with the truth and there is evidence staring them in the face.
If you find any part of this site untrue and produce evidence to show this, I will gladly highlight your concerns on this website, I have absolutely nothing to hide.
This driver management at TPE are ruthless bullies, they are a law unto themselves and are quite simply out of control, please don’t take my
word on this, ask the drivers themselves, but ask them without management anywhere near, because many of them quite rightly are scared of retribution. Please read the "Information Received" sections regarding the above.
Once again, I thank you very much for your valuable time. I have never given up because when everything you have is ruthlessly and vindictively taken from you without substance and you have evidence to prove this, you know that eventually you will be vindicated one way or another, it may take years, but for me the time is all mine.
I know that it is easy to write issues down on a website, but it lacks real emotion and feeling, I am not in anyway a person who is unapproachable or paranoid, or obsessive, I am however a person who has morals, I believe strongly in everyone being treated equal with dignity, if this doesn`t happen then I will speak my mind, (this was my only downfall).
I was always polite, maybe sometimes a little hasty, but my concerns were always about issues of health and safety. To be ignored time and time again is really hard to take, all I ever wanted and repeatedly asked for was someone to sit down and give me answers, if they didn`t have an answer just an explanation why, would have been suffice.
Mr O`Toole, if you are going to look into my concerns then I would like to suggest that whoever looks into this actually meets with me, this way you will have more of an idea of what actually happened and can ask any questions you like, I will meet you or your representatives anywhere in the country.
Should you require any further information please ask.
I believe my questions have caused discomfort among the TPE managers concerned, if they had nothing to hide then they would answer them and lay this website to rest, especially if they are all truthful, but that is totally impossible through their own glaring mistakes and above all else LIES.

(03:01:2018) I sent this email to CEO Tim O'Toole in 2013, all he had to do was listen to me, I gave him an open invite. Sadly his failure to listen is one of the reasons seven people lost their lives, they lost their lives because the "basics" were ignored, but as anyone who has read through this website can see, this is a First Group disease which has reached epidemic proportions. Sadly something similar will happen again, they are a ticking time-bomb.
