GRIEVANCE FROM EVENTS OF DECEMBER 2003
PRESENTED TO TRANSPENNINE EXPRESS APRIL 2004
Below are a series of reports regarding an outstanding grievance for deduction of 8 hours 31 minutes loss of pay. This was due to a ruling that Arriva had concerning ringing control at least one hour before going sick, failure to do this resulted in loss of pay.
On the 30th December 2003 I rang in sick, I did this just before the hour deadline, but Arriva said it was 4 minutes late which I disputed.
This grievance was TUPED across to TPE. The paperwork before 2005 was all given to Manager Andrew Gorton who was supposed sort this out. Chris Swift, Andrew Gorton, Barry Cook, John Moans, Peter Turpin and all my other line managers were at one time or another involved.
Not one of these managers came anywhere near sorting this out, all I ever encountered was false promises including the latest one from Manager Peter Turpin who said he would speak to Charlotte and get it paid to me, that was January (2009) after the “quite word” incident which Stephen Percival used in his investigation report against me.
Why do you think that this grievance has taken over 5 years and is still not sorted? The ignorance is there for all to see. I was hated for standing my ground while carrying out Trade Union duties and this was one of the ways to get back at me.
I was deliberately ignored to provoke a reaction. If you can come up with any other reason then please let me know. How can TPE explain why this was never dealt with, despite so many reminders?
If you are a Manager, Driver, Conductor or anyone else from another Rail Operating Company, maybe even a First Group Company, let me ask you, have you ever known a grievance take over 5 years and still not be resolved? Can you think of any reason why this management failed to resolve this grievance?
Below are my requests to have this grievance resolved, what is additionally interesting are the other issues that I have raised on these report forms as you will see.

1. Notice the slight sarcasm, but then again,just like the grievance, I could never get a reply.

Let me ask you, if as a Manager you received this request what would your immediate thoughts be? I would initially think why is it not resolved after 19 months.
"The usual incompetence", would suggest to me that other issues are not resolved.
Would I be happy about it? I don`t think anyone would be happy about this.

This report complains about, defects being ignored, a common occurrence.
Complaint about the vile stench of fumes we all had to breathe in while traveling through Standedge Tunnel, as always this was mentioned previously but ignored.

A report about the vile stinking working conditions we all had to put up with from the class 158 cabs.
But more importantly was the freezing working conditions we all endured. To combat the drafts, sticky tape was used which was of no use whatsoever.
Grievance mentioned yet again.
Complaint about Environmental Tobacco Smoke (ETS) stinking the small signing on point out and lack of cleanliness.
I was always ignored on ETS, TransPennine`s own managers even smoked in driving cabs such was their ignorance.
The grievance is now 2 years and 3 months old!
My request for answers to my many reports that simply went unanswered.
This report speaks for itself!
1. Sauna like working conditions.
2. Nigel Smith, a driver that in my opinion was picked upon and given the nickname, "Nervous", my report on his SPAD was proof that there were enough mitigating circumstances not to demote him.
3. Numerous reports on dirty windscreens.
4. Risk assessment requested, of course never undertaken.
5. The usual IGNORANCE prevails.
6. They wouldn`t even let me have access to their safety case!
7. GRIEVANCE still ongoing.
8. Threaten a meeting with the HMRI to try and get some responses to my reports.
1. Firstly I would like to say how sad it was to hear about the death of Chris, I spoke with Chris on many occasions, he was extremely frustrated at the way he believed his immediate managers Stephen Percival and Andrew Steele treated him,
Of course I do have a report from Chris where he makes clear what his feelings are, like I have always said throughout this website, I can always back up everything with evidence.

2. A case of driver unfamiliarity with the new 185 units. Training issue?
3. I highlight my GRIEVANCE again!
1. Non compliance with the statutory 3 month health and safety inspections.
2. I had to get the Office of the Rail Regulator involved because of the constant ignorance, they suggested a meeting with the safety section which of course never happened, a comprehensive section with all the letters will be added soon.
3. GRIEVANCE still outstanding.
Clear concerns over the class 185 units, I shouldn`t have to ask about the braking and sanding systems, this should have been briefed to us during our training.
Also note the concerns regarding other issues, especially the noise in the cab, which Route Driver Manager Mark Atkinson describes like this in his witness statement, " 22.2 the excessive noise in the cab was always present on the Company's 185 trains".
Should it really have to come to this?
Is there any wonder that I felt totally dejected?
This actually goes beyond IGNORANCE, this is sheer bullying, I CHALLENGE ANY ONE OF TPE MANAGEMENT TO EXPLAIN WHY I WAS ALWAYS IGNORED, but realistically thinking about this, I am asking the impossible, because they are all oblivious to their own IGNORANCE.

WARNING HORNS
This is one of many reports highlighting this problem, notice that this report is over 2 years before my incident.
A simple answer to this question would have prevented me writing what I said. This question is asked numerous times as I will show, what happens on the day when you first go to use your warning horn and nothing happens?
My own Risk Assessment of this in simplistic terms is:
"Faulty equipment combined with distraction and ignorance
= DEATH"!
