.’ THE FALSE ACCUSATION
“noise and draught through driver`s side door drop down window, noise levels excessive. TRUE, ACTUALLY HAPPENED.
Windscreen wiper only working on fast speed, intermittently stopping all together. TRUE, ACTUALLY HAPPENED.
Warning horn took ages till it eventually worked, possibly frozen. All of this combined, led to a near miss with p way staff (track workers), distracted by noise, unable to obtain a clear view and unable to give adequate warning. FALSE, NEVER HAPPENED, BUT COULD ONE DAY!
Yet all I ever see is, tested on depot, ok, somebody needs to wake up to these problems and now”. TRUE ACTUALLY HAPPENED.
WHY DO IT?
Why indeed? Being a staunch Trade Unionist I couldn`t sit back and ignore this issue, also having an excellent knowledge of health & safety, I knew that by TPE and SIEMENS constantly IGNORING this frightening issue, peoples lives were being put at risk.
I had done everything within the limited powers I had to try and get this issue noticed, written reports, using the innovative and unprecedented Injury Prevention Programme and verbally to Management, all sadly IGNORED, not even one response!
Do you know what IGNORANCE does to a person? Especially when this IGNORANCE is being used as a weapon, a weapon that is used deliberately to get a response that they knew could be used against me. Because that is exactly what they did, they IGNORED virtually every single report that I made, they also ignored my evidence at my hearing and appeal as shown in those sections, proof that this IGNORANCE was deep rooted and aimed at me in a vindictive fashion is highlighted in the section, "Outstanding Grievance", their IGNORANCE rolled on and on and on.
Just regarding my grievance, is there one TPE Manager out there who can explain to me why you IGNORED my grievance? Peter Turpin, what have you got to say about this? Let's also not forget that for most of the time, you were my allocated Driver Manager who IGNORED everything.
What happened to your own Grievance Procedures? Lets be honest, even 1 year would have been excessive, but 5 years, YES FIVE YEARS and nowhere near sorted!
But what any person who has not been on the receiving end of any of this cannot see, is the psychological damage this does to a person, it tears you apart from the inside outwards and turns you into a very nasty person, there is more on how this makes me feel, in the section, "bullying and me".
I could have involved the Managing Director, but as my evidence has shown when I gave information on reversing a train, I did not get any response and the information disappeared into the IP Process black hole.
I could have tried complaining to the Office of the Rail Regulator, but once again as my evidence shows, the 2 times that I attempted to inform the ORR on unrelated issues, TPE Management told them a pack of LIES that I never informed them of the problems.
I felt really strongly about this warning horn issue, because I sadly witnessed a man being hit by a train and killed at Trafford Park.
Track Worker Killed By Train
A RAILWAY subcontractor died after he was hit by a high-speed train while working to install safety equipment on a line. Lindsey Warrington, 60, moved out of the path of one passenger train but was hit by another travelling in the opposite direction at 82mph.
An inquest was told the married father, also known as Les, suffered "dreadful head injuries". He died instantly in the incident at Old Trafford on October 26 last year. Peter Phillips, a supervisor with a firm Carillion who was standing next to Mr Warrington, when he was hit, said: "I saw a train coming and shouted `Stand clear, lads'.
We started to move off. The next thing I was on my back and Les was on the ground next to me. Another train must have come past and knocked us over. "I don't know if I was knocked over by the train, the draught, or by Les. I was scared to move him in case I made him worse.
I dialled 999 and told him I had called for paramedics but he made no response." Another man was with them when the incident happened next to Manchester United's stadium at about 9.30am but he was standing in a different place and was answering a call on his mobile phone.
My Account
I witnessed this chain of events unfolding in front of me, as I was building up speed towards Old Trafford, I saw 3 men in front of me all wearing high visibility clothing. One man went to my left and out of sight, the other 2 men moved out of my way and stood next to the opposite line. These 2 men were facing each other, with the larger man having his back towards oncoming traffic and obstructing the other mans view.
As I approached these 2 men a train came towards them from the opposite direction, realising how close they were to the opposite line, I held my warning horn down to try and warn them, it was less than 3 seconds before the other train passed my train. I hoped that the 2 men had got out of the way, sadly on arrival in Liverpool I heard the bad news.
This made me feel physically sick and I couldn`t drive my train back to York through shock. However at Manchester on the way back, I was taken off a train and interviewed about the incident, I was then met at York and interviewed again, TPE Management tried to say that my train was nowhere near that incident when it happened.
INQUEST AND SCENARIO
I went to the inquest as a witness on my own, not one Manager from TPE had the decency to accompany me, this though is hardly surprising given their track record. The train driver of the train that hit the track worker said he was blinded by low sun and didn`t see the men until too late.
SCENARIO: Lets imagine the train coming the other way was a TransPennine Express Class 185 unit with a partial failure of the warning horn and when the Driver see`s these 2 men stood in front of him the other tone on his warning horn fails, (which as Route Driver Manager Mark Atkinson said, "as there is always the possibility that the other horn would fail"). The outcome would have been exactly the same as what happened here, DEATH.
My attempt to try and warn TPE management was because of Route Driver Mark Atkinson's famous quote, "AS THERE IS ALWAYS THE POSSIBILITY THAT THE OTHER HORN WOULD FAIL". I had literally tried every option open to me, my frustration was well past boiling point, it was also well past the stupid game of writing another report and stating STOP THE IGNORANCE, because that is all it became, nothing more than a game, which when you are informing those in charge of serious safety issues should it really be treated with contempt?
I was simply the sacrificial lamb, lulled to a false sense of security by this ignorant management, trapped but not in the sense that this trap had killed me, but then callously and ruthlessly slaughtered by an injustice of tangled lies and deceit.
THEIR LIES AND DECEIT ARE ON THIS WEBSITE FOR EVERYONE TO SEE, WHAT YOU CANNOT SEE IS THE ANGER, ANGUISH, PAIN AND DESOLATION THIS HAS CAUSED TO ME. REMEMBER...............................
"If you prick us do we not bleed? If you tickle us do we not laugh? If you poison us do we not die? And if you wrong us shall we not revenge"?
